1. Who we are
These terms are between you and Safewire Payments Ltd, a company incorporated in British Columbia, Canada (registration BC1409745) (“Safewire”, “we”, “us”). “Safewire” is a trade name of Safewire Payments Ltd.
Safewire is a technology company. We build self-custodial wallet software and payment infrastructure. We are not a bank. Your funds are not deposits, are not held by us, do not appear on our balance sheet, and are not covered by any depositor-protection or insurance scheme. Some services available through the app are provided by licensed third parties, identified where they appear.
2. Self-custody — the heart of the service
Your wallet's cryptographic keys are generated and stored on your own device. Safewire never has access to your keys or your funds and cannot move, spend, freeze, or recover them. Every movement of your funds requires your approval, given on your device.
When you create a wallet you are shown your Secret Recovery Words. They are the master key to your funds: anyone who has them controls your money, and no one at Safewire will ever ask for them. Keep them safe and private.
The app offers optional recovery features (for example a passkey, a cloud backup, or a PIN). These store only encrypted data that Safewire cannot read; only factors you control can unlock it. If you lose your Secret Recovery Words and all recovery factors you have set up, your funds cannot be recovered — by you, by Safewire, or by anyone else.
3. What the app does
The app lets you hold, receive, and send stablecoins and other digital assets you control; pay participating merchants; view your balances and history; and hold digital identity credentials. Features vary by region and verification level.
4. Payments
You authorize every payment by approving it in the app; your approval is a cryptographic signature made on your device, and it alone fixes the amount and the recipient. Payments execute through open-source, immutable smart contracts and settle directly from your wallet to the recipient's own wallet. Safewire cannot alter any term of a payment you have signed.
Blockchain payments are irreversible once confirmed. Check the recipient and amount before you approve; a payment sent in error can only be returned by whoever received it.
Network fees. So that you never need to hold the blockchain's own fee token, Safewire covers network (“gas”) fees for eligible payments — by delivering your signed payment to the network and paying the fee, and/or by providing small amounts of the network's fee token to your wallet. Fee coverage is a service we provide subject to reasonable usage limits; it never changes what you signed.
5. Our fee
Safewire charges a network fee for use of the infrastructure, shown to you before you approve a payment and included in what you sign. We take no exchange spread, no conversion commission, and no percentage of any exchange of value. We do not provide currency conversion or exchange services.
6. Merchants
Merchants on Safewire are independent businesses. A purchase is between you and the merchant: the goods, the service, and any dispute or refund are the merchant's responsibility, and a refund is a new payment made by the merchant (we cannot reverse payments — see section 4).
Where a merchant offers cash services at its counter (exchanging cash and stablecoin), that exchange is provided by the merchant, at the merchant's own rate and commission. Safewire is not a party to it. The app shows you the merchant's terms before you accept them.
7. Buying with a card
Card purchases of stablecoin are provided by Unlimit, a licensed payment institution, under its own terms presented at purchase. Safewire does not receive or hold your card details or your fiat money.
8. Swaps
The app can connect you to third-party decentralized exchange protocols to swap assets you control. Safewire does not operate those protocols, is not a party to any swap, and does not set exchange rates. Any service fee that applies is shown in the app before you approve.
9. Verification and network standards
Safewire applies one standard across its network: participants are verified, and usage limits apply by verification level, modeled on Canadian federal financial-crime standards. You agree to provide truthful, current information when asked, and to use the services only for lawful purposes.
If we limit or suspend services to you, the limitation applies to our services only — such as fee coverage and app features. It never applies to your funds, which remain yours and under your sole control at all times, and which you can move using your own keys and any compatible tools.
10. Your responsibilities
- Keep your device, PIN, passkeys and Secret Recovery Words secure.
- Comply with the laws that apply to you, including sanctions laws; do not use the services in connection with the proceeds of crime.
- Your tax, reporting, and other legal obligations in your own jurisdiction are yours.
11. Risks you accept
- Digital assets can lose value; a stablecoin's value depends on its issuer and can deviate from its reference currency.
- Blockchain transactions are final; mistaken payments may be unrecoverable.
- Blockchains, networks and smart contracts can suffer congestion, forks, outages or defects outside our control.
- Self-custody means the safety of your keys is in your hands.
12. App versions
For your protection we may set a minimum supported app version where older versions are no longer safe to operate; the app will ask you to update, and your funds remain accessible to you throughout (see section 2).
13. Software, availability and changes
We grant you a personal, non-exclusive, non-transferable licence to use the app. We work to keep the services available but do not promise uninterrupted operation, and we may change or discontinue features. The Safewire name, marks and software are the property of Safewire or its licensors and are protected by copyright, trademark, and other applicable laws.
14. Liability
The services are provided “as is” and “as available” to the maximum extent the law allows, without warranties of any kind, express or implied. Nothing in these terms excludes rights that cannot be excluded under the consumer laws that apply to you, or liability for fraud, or for death or personal injury caused by negligence.
To the extent permitted by law, Safewire's total aggregate liability arising out of or in connection with the services is limited to the network fees you paid to Safewire in the twelve months before the event giving rise to the claim. Safewire is not liable for losses arising from your loss of keys or Secret Recovery Words, from blockchain or third-party failures, or from your dealings with merchants.
15. Indemnity
To the extent permitted by applicable law, you agree to indemnify Safewire against any liability, cost, claim, loss, or expense arising directly from your breach of these terms or your unlawful use of the services.
16. Ending
You can stop using Safewire at any time. Because your funds are self-custodied, ending these terms does not affect them: your keys use open standards, and your Secret Recovery Words can restore your wallet in compatible software. We may suspend or end our services to you for breach, risk, or legal reasons — subject always to section 9: your funds are never affected.
17. Changes to these terms
We may update these terms; material changes will be notified in the app before they take effect. Continued use after the effective date is acceptance.
18. Governing law and disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict of law provisions. The parties submit to the exclusive jurisdiction of the courts of Vancouver, Canada, except where the consumer laws of your place of residence give you the right to bring proceedings there. If any provision of these terms is held invalid, the remaining provisions remain in effect; our failure to enforce a right is not a waiver of it.
